Welcome to Angelica Jewellers. These Terms and Conditions ("Terms") govern your access to and use of angelicajewellers.com (the "Site") and any purchase you make through it. By browsing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Eligibility & Accounts

You must be able to form a legally binding contract to place an order with us. If you create an account, you are responsible for maintaining the confidentiality of your login information and for all activity under your account. Please notify us immediately if you suspect unauthorized use of your account.

Products, Pricing & Availability

We make reasonable efforts to ensure that product descriptions, photographs, and prices displayed on the Site are accurate and current. However, errors may occasionally occur.

Because our pieces are often photographed and viewed on different screens, actual colour, size, and finish may vary slightly from what is shown online due to lighting, photography, and display settings.

In the event of an obvious pricing, description, or technical error, we will contact you before processing or shipping the affected order. Any advertised price that is clearly inaccurate is not binding on Angelica Jewellers, and we reserve the right to cancel or correct such orders.

We reserve the right to refuse, limit, or cancel any order, including in cases of suspected fraud, unauthorized or unlawful activity, or unavailability of merchandise, subject to applicable law.

Diamonds, Gemstones & Natural Variation

Diamonds, gemstones, and pearls are natural materials, and slight variations are normal and expected rather than a defect. Carat weight may vary by approximately 0.05 carats, and gemstone or pearl measurements may vary by approximately 0.25 millimetres from the stated figures, consistent with standard industry tolerances.

Where a piece is sold with a diamond or gemstone grading report or certificate, that document must accompany the item if it is returned or exchanged. Items returned without their original certificate may be subject to a certificate replacement fee, or the certificate cost may be deducted from any applicable refund, in accordance with our Return, Exchange & Refund Policy.

Where a piece contains multiple diamonds or gemstones, any quality grade referenced (colour, clarity, cut) reflects an average or minimum grade across the stones used, unless stated otherwise.

Orders, Payment & Shipping

Order processing, production timelines, shipping, customs, and delivery are governed by our separate Orders & International Shipping Policy, which forms part of these Terms. Returns, exchanges, and refunds are governed by our Return, Exchange & Refund Policy.

We accept payment methods as indicated at checkout. By submitting an order, you confirm that you are authorized to use the selected payment method.

Authorized Sales & Authenticity

Angelica Jewellers products purchased directly through this Site, our physical location, or another channel we expressly authorize are guaranteed authentic. We are not responsible for the authenticity, quality, or condition of merchandise purchased through unauthorized third parties or resellers.

Intellectual Property

All content on the Site, including text, graphics, logos, product photography, and design, is the property of Angelica Jewellers or its licensors and is protected by applicable intellectual property laws. You may view and use this content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or otherwise exploit any content from the Site without our prior written consent.

You are solely responsible for the content you submit and confirm that it does not infringe any third party's rights.

The Site may contain links to third-party websites or services that are not owned or controlled by Angelica Jewellers. We are not responsible for the content, policies, or practices of any third-party site, and inclusion of a link does not imply endorsement.

Disclaimer of Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, except as required by applicable law. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the fullest extent permitted by applicable law, Angelica Jewellers will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of our products. Our total liability for any claim relating to a purchase will not exceed the amount you paid for the product giving rise to the claim.

Nothing in this section limits any liability that cannot be excluded or limited under applicable Quebec or Canadian law, including liability for gross negligence, wilful misconduct, or mandatory consumer-protection obligations.

Indemnification

Governing Law & Jurisdiction

These Terms are governed by the laws of the Province of Quebec and the applicable federal laws of Canada, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally may be brought before the courts of the judicial district of Montreal, Quebec, without prejudice to any right you may have to bring proceedings before the courts of your own place of residence under applicable consumer-protection law.

Consumer Rights

Nothing in these Terms is intended to exclude, restrict, or waive any mandatory consumer rights that cannot legally be excluded or waived. Quebec customers retain all rights provided under the Consumer Protection Act (Quebec) and other applicable Quebec legislation. Customers located outside Quebec may have additional mandatory rights under the laws applicable to their transaction. Where a mandatory legal requirement conflicts with these Terms, the mandatory requirement will prevail to the extent required by law.

Severability & Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Orders & International Shipping Policy, Return, Exchange & Refund Policy, and Privacy Policy, constitute the entire agreement between you and Angelica Jewellers regarding your use of the Site.
